Child Care Leave 90 days for TS Women Employees-Sanctioning Guidelines- TS GO.209 released under PRC 2015-: Child Care Leave 90 days for TS Women Employees, Child Care Leave for 3 months(90 days) to women employees, Child care leave account: Govt of Telangana, Finance Department is going to Sanction of Child Care Leave for three months to the women employees of the State in Recommendations of Tenth Pay Revision Commission on Child Care Leave.

Child Care Leave: Child Care Leave to the Women Employees: Based on the recommendation of the 6th Central Pay Commission the Government of India issued orders permitting the Women employees of the Government of India having minor children, to avail of Child Care leave for a maximum period of 2 years (i.e. 730 days) during their entire service for taking care upto 2 children whether for rearing or to look after any of their needs like 81 examination, sickness etc.

Child Care leave shall not be admissible if the child is eighteen years of age or older. (vide O.M.No.10318/2/2008‐Estt.(L) dated:11‐ 9‐2008 of Department of Per. Trg. Government of India) It was further clarified by the Government of India that this child care leave shall be admissible for the two eldest surviving children only. Now, the Women employees of the State Government are eligible for the grant of Child Care leave 90 days.

Majority of employees Associations have represented to this Commission to recommend for all women employees two years of the Child Care Leave stating that employees were now living in nucleus families consisting of wife and husband and elderly people were no longer available to take care of the young children. When combined family structure was prevailing, elderly people of the family used to look after the health and personal care of the children. Hence women employees are facing hardship regarding child care. Another request is to allow the above leave in different spells in the entire service and also requested for not linking this leave to Maternity leave. The Commission considers the demand to be reasonable and recommends sanction of Child Care Leave of upto 2 years to all women employees in the entire service career, to look after 2 eldest children up to the age of 18 years.

The Telangana government on 21/11/2016 issued orders sanctioning Child Care Leave for three months to women employees as recommended by the 10th Pay Revision Commission. The Commission, in its report, had recommended sanction of Child Care Leave to all women employees to look after two eldest children up to the age of 18 years. Accepting the recommendation, the government issued orders stating that women employees of the State Government having minor children be granted Child Care Leave, by the authority competent to grant leave, for a period of three months, not exceeding 15 days in any spell, in the entire service to look after two eldest children up to the age of 18 years (22 years in case of disabled children) for any of their needs like examinations, sickness etc. Child Care leave of three months can be sanctioned in not less than six spells to look after two eldest children up to the age of 18 years and in case of disabled children up to 22 years. The Child Care leave shall be permitted only if the child is dependent on and residing with the government servant. LTC cannot be availed during the Child Care Leave.


GO. 209 - Child Care Leave 90 days Sanctioning Guidelines for TS Women Employees: The women employees may be permitted to avail child care leave for Three months viz., Ninety days in the entire service to take care of the minor child for rearing or for looking after any other needs of the child during school or college examinations, sickness etc., subject to the Child Care Leave TS GO.209 conditions.

ORDER: In the Government Order 3rd read above, orders were issued constituting 10th Pay Revision Commission and Government appointed Sri P.K. Agarwal, IAS (retired) as Pay Commissioner.

2. The 10th Pay Revision Commission submitted its report to the Government which, interalia, recommended sanction of Child Care Leave to all women employees to look after two eldest children upto the age of eighteen (18) years.

3. Government, after careful consideration of the report, hereby order that women employees of the State Government having minor children be granted Child Care Leave, by the authority competent to grant leave, for a period of three (3) months, not exceeding 15 days in any spell, in the entire service to look after two eldest children upto the age of 18 years (22 years in case of disabled children) for any of their needs like examinations, sickness etc., subject to the following conditions:

a) Three(3) months to be sanctioned in 6 Spells: Child Care leave of three months can be sanctioned in not less than 6 spells to look after two eldest children up to the age of 18 years and in case of disabled children up to 22 years. The Child Care leave shall be permitted only if the child is dependent on and residing with the Government servant.

b) LTC: LTC cannot be availed during the Child Care Leave.

c) Child care leave account: The leave account for child care shall be maintained in the prescribed proforma enclosed and it shall be kept along with the Service Book of Government servant concerned. The leave shall be deducted from the child care leave account. It should not be clubbed with regular leave account.

d) The Head of the office shall ensure that the availment of Child Care leave to an employee will not affect the functioning of the office for which necessary orders depending upon the circumstances of the office may be issued.

e) Child Care leave cannot be construed as a matter of right. It requires the prior sanction of the competent authority.

f) The Women employees shall be paid leave salary equal to the pay drawn immediately before proceedings on leave.

g) Child Care Leave may be combined with leave of any kind due and admissible, except LTC.

h) The Child Care Leave is admissible during the period of probation also. However, the period of probation shall be extended to that extent.

i) The existing facility of maternity leave up to 180 days is separate from the Child Care Leave and the Child Care leave may be sanctioned in continuation of maternity leave or any other leave, other than Casual Leave and Spl.Casual leave.

5. These orders shall come into force with immediate effect.
