The attention of all the Regional Joint Directors and District Educational Officers in the State is invited to the reference 1st read above. They are informed that the Government of India enacted Right of Children to Free and Compulsory Education Act, 2009, which came forthwith into effect from 01.04 .2010. This Act prohibits holding of screening tests for admission into Classes I to Vlll in Schools in India (including pre-primary Classes). As per Section 2 (I) of RTE Act -2009, elementary education" means the education from first class to eight class. Accordingly Government vide G.O.Ms.No.20, School Education (P.E.Prog.J) Dept. Dated 03-03-201 l issued Rules to RTE Act -2009.
Further, they are informed that in the reference 3rd read above, Government have used orders regarding Prohibition of Screening Test and Collection of Capitation fees for Private Recognized Schools. The G.O. clearly Says that any other fee or amount collected either from student or parent or guardian or any other person on behalf of student shall be treated as Caption fee under Section 13(2) (a) of the Right of Children of Free and Compulsory Education Act 2009 punishable with fine which may extend 10 times the Caption fee charged.

Further, they are informed that in the reference 4th read above, the Regional Director - South, Aakash Medical (IIT-JEE Foundation, Andhra Pradesh) has informed that they are imparting coaching to the children, who are preparing/ appearing for the various competitive examinations. They offered that they are providing only extra Tuition/Coaching to student. They sought permission for conducting of National Talent Hunt Exam, for Classes IX & X students at Tirupathi.

Talent Tests are conducted by various organizations across the country giving an opportunity to students in Secondary and Senior Secondary classes to test themselves against National Bench mark test. their levels of preparation, obtaining a scholarship etc. Where such organizations / institutions conduct talent test beyond the purview of RTE Act, 2009 and beyond Elementary Education classes, not for admissions purpose they may be permitted to conduct the test.

All the Regional Joint Directors of School Education and the Di.strict Educational Officers in the State arc instructed to not prevent or accord  permission to such organizations/ institutions those who are conducting of Talent test for the Secondary School students of classes IX and X and above.
